the Commitee "Free Hemp" may continue activities
The Polish Supreme Court overruled the judgment of the Polish Parliament speaker, who refused to accept the acknowledgment of establishment of the "Free Hemp" Legislative Initiative Committee. With this decision the court took into consideration the complain filed by the Committee. The establishment of the Committee was blocked by Bronislaw Komorowski in June this year, when he was still the speaker of the Polish Parliament. Mr. Komorowski objected the acknowledgment because of its formal defects, among others the missing expert’s opinions.
Accorrding to Teresa Pyźlak from the Supreme Court, on further investigation of the complain put in by "Free Hemp" Legislative Initiative Committee the court accepted the complain and overruled appealed decision. This verdict means that the Commitee may continue activities leading to soft drugs legalization initiative to be brought in Parlament. The calling of citizen’s Parliamentary initiative into existence was acknowledged by the organizers of yearly Free Hemp March in May this year.

The establishment of committee for Parliamentary initiative is obligatory for starting with collection of 100.000 signatures under the proposed legislatory project. The collection could start only after committee registration. The acknowledgment of the establishment of the committee was presented to the Parliamentary speaker in the mid June. In the early August the speaker refused to accept the acknowledgment. He reasoned that the acknowledgment had formal defects and there was no opinions from Head Medical Chamber and Attorney General. The Committee didn’t agree with this reasoning.
It is a vicious circle because attorney general responded that he is not going to give any opinion until speakers acceptance is issued - argued Jedrzej Sadowski, Free Hemp representative. I think that such opinion was given due to the election time. The speaker didn’t want that issue to be undertaken during an election campaign - he added.
The governmental project already in Parliament
The government is already working on the amendment of the present legislation aiming at unpunishability for posession of small amounts of drugs. On 24 of August the governmental project was sent to the lower chamber of the Polish Parliament regarding changes in the Anti-Narcotics Act, in which restricted penalization was introduced for possession of drugs for private consumption.
According to this project, the procecutor and courts could depart from punishment for possession of psychoactive drugs and psychotropic substances in case, when a small amount of drug was possessed for only private consumption and the possessor is not a dealer Such a situation - according to Ministry of Justice who prepared that project.- implies low social noxiousness of the deed.
The project proposed by Free Hemp is much more liberal. The changes in law should definitely end punishment for possession of small amounts of intoxicating drugs. It should apply especially for small amounts of marihuana - wrote organizers of Free Hemp March in their leaflets. The citizen’s project envisions also unpunishability for growing small amounts of marihuana for the private purpose.
